Food Marketing Institute v. Argus Leader UPDATE

Kevin Goldberg, NLA’s lawyer who does our wonderful weekly legal video series, published a CommLawClarified video yesterday for Fletcher, Heald & Hildreth about the FOIA case, Food Marketing Institute v. Argus Leader. We feel this is important to share with you, our members, as ASNE and APME joined an amicus brief in this case.

Unfortunately, the Supreme Court ruled against us in this case, holding that the Supplemental Nutritional Assistance Program information sought by the paper (specifically, retail sales information from years 2005-2010) can be withheld from disclosure by the United States Department of Agriculture under Exemption 4 of the Freedom of Information Act. This is the first time the Supreme Court has ruled on Exemption 4.
